Terms and Conditions
These Terms and Conditions govern the relationship between Forward Printing, LLC (hereafter referred to as "we," "us," or "our") and our customers (hereafter referred to as "you" or "your"). By placing an order with us, you agree to these terms.
General Service Terms
- Service Description: We provide custom screen printing and embroidery services, including but not limited to apparel printing and headwear decoration.
- Order Process: All orders must be submitted through our website or in person. Customers will receive a quote that is valid for 30 days unless otherwise specified.
- Approval Process: Before production begins, you must approve the final quote and any design proofs. Changes after approval may incur additional costs.
- Mockup Process: We provide digital mockups for your approval before printing. You must review and approve these mockups, understanding that any discrepancies or mistakes not corrected at this stage are your responsibility.
Payment Terms
- Payment Requirement: Full payment is required upon order confirmation.
- Payment Methods: We accept various forms of payment, including credit cards, paypal, ACH and checks. Full payment must be received before order confirmation.
- Order Cancellation: If an order is cancelled after work has been done or products have been ordered, you may be liable to cover the costs of work completed or restocking and shipping fees incurred by return products.
- Payment Deadlines: Full payment is due before production begins.
- Non-Payment: Orders will not proceed until payment is received. Non-payment may lead to order termination without refund.
Production and Delivery
- Production Timeline: Standard production time is 10 business days although this may vary depending on demand. You must notify us if you have a hard in-hands date. Rush orders may be available for an additional fee.
- Shipping Policy: We ship orders via UPS. You are responsible for providing accurate shipping information.
Quantity Considerations
- To ensure that you receive the exact final quantities needed, we recommend ordering an additional 5% over your desired quantity. This helps account for any potential misprints or defects that may occur during production.
Quality Assurance and Liability
- Quality Control: We strive for high-quality prints; however, a damage rate of up to 5% may occur due to the nature of screen printing. We remove any defective items from the order prior to shipping. If you find defective items or incorrect quantities in your shipment, claims for refund or invoice adjustment must be reported within 48 hours of receipt.
- Customer Supplied Products: We rarely decorate customer supplied products. In the event that we do, we require upfront disclosure of the individual product costs. We may choose avoid decorating high cost products. We could be liable for replacement costs if we exceed a misprint rate of over 5% per design variation.
- Limitation of Liability: We are not liable for any indirect, incidental, or consequential damages arising from the use of our services. This includes delays, misprints, or missed deadlines.
Customer Submitted Artwork or Graphics
- Artwork must be submitted in the required color mode, resolution, and file format. We are not responsible for print quality issues arising from files that do not meet these specifications.
Color Matching
While we endeavor to match colors as closely as possible, variations can occur. We do not guarantee exact color matches, especially with customer-supplied artwork.
Intellectual Property
- Copyright Policy: You are responsible for ensuring that any artwork provided does not infringe on copyright laws. We reserve the right to refuse any job that violates copyright regulations.
- Artwork Ownership: All artwork produced by Forward Printing remains our property unless purchased outright by the client.
- Use of Process Videos and Pictures: We may use images or videos of the printing process for promotional purposes, with your intellectual property rights retained by you.
- Content Guidelines: We do not pre-screen content but reserve the right to refuse or remove illegal content, including but not limited to:
- Material that infringes on copyright or trademark laws.
- Content that promotes discrimination, harassment, or violence.
Termination Clause
We reserve the right to terminate any order if you violate these terms or if we encounter legal liabilities due to your actions.
Shipping and Delivery
- Estimates: Delivery times are estimates; we are not responsible for delays caused by shipping companies or third-party carriers.
- Damages: We are not liable for damages during transit. Claims must be made within 48 hours of receipt.
Amendments
We may update these Terms and Conditions at any time without prior notice. Continued use of our services after changes constitutes acceptance of the new terms.
Governing Law
These Terms and Conditions are governed by the laws of **City Court of the City of Tucson, Pima County, State of Arizona**. Any disputes will be resolved in accordance with these laws.
Miscellaneous
- Entire Agreement: This document constitutes the entire understanding between you and Forward Printing regarding the use of our services, superseding all prior negotiations, representations, and agreements.
- Indemnity: You agree to indemnify Forward Printing for any claims, damages, or expenses arising from your use of our services or any violation of these terms.
By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
